ChatExpertHub is an online platform provided by ChatExpertHub (referred to as "ChatExpertHub," "We," "Us," or "Our") that allows users ("You") to access and use our legal services via WhatsApp, website, and mobile applications. These Terms of Service for ChatExpertHub ("Terms"), along with ChatExpertHub's Privacy Policy ("Privacy Policy") (collectively referred to as the "Platform Policies"), govern the relationship between You and Us. The Terms and Privacy Policy establish a binding legal agreement under which You may access, use, or interact with ChatExpertHub's products, website, mobile applications, and related services ("Services"). By using our Services, You agree to abide by the Platform Policies. We recommend reviewing the Platform Policies thoroughly before utilizing Our Services. If You do not accept any portion of the Platform Policies or any updates made to them, You must cease using or accessing our Services. We reserve the right to review, amend, or modify any part of the Platform Policies at our discretion. It is your responsibility to stay informed about the latest updates to the Platform Policies. Any significant changes will be communicated to You, and Your continued use of the Services after such notice indicates your acceptance of the revised policies. If any provision of these Terms is found to be invalid or unlawful by a competent authority in India, the remaining provisions will continue to remain valid and enforceable.

3. Registration and Eligibility

Access to the Platform and use of Our Services is limited to individuals who are legally capable of entering into binding contracts under the Indian Contract Act, 1872. Users under the age of 18 are prohibited from registering or using Our Services. We reserve the right to deny or terminate access to Our Services if it is determined that You lack the legal capacity to enter into a contract. You may access Our Services through WhatsApp using Your phone number ("Login Details"). However, You are explicitly prohibited from:

  • Providing inaccurate or misleading personal information, or creating an account on behalf of another person without their explicit consent.
  • Accessing another individual’s Login Details with the intent to impersonate them.

4. Usage of Services

You can access Our Services via WhatsApp, our website, or mobile applications available on Google Play and the Apple App Store. By accessing Our Services and/or creating a ChatExpertHub account, You acknowledge that We may collect, use, share, and store Your information, including both personal and sensitive data, to provide effective service. The collection and use of such information are governed by our Privacy Policy. By agreeing to these Terms, You consent to Us contacting You via Your mobile number, even if it is registered under a Do Not Disturb (DND) service. You also agree to receive promotional and service-related communications from Us and Our affiliates through SMS, email, calls, and push notifications. You may withdraw your consent at any time by emailing support@chatexperthub.com. We are not responsible for any connectivity issues, local internet disruptions, or device-related problems that may affect Your use of Our Services. You are responsible for ensuring that Your devices are protected from malware, viruses, spyware, and other harmful software. We are not liable for any damages arising from Your use or misuse of Our Platform.

5. Prohibited Use

You are prohibited from:

  • Uploading, distributing, transmitting, publishing, or sharing content that is defamatory, obscene, invasive of privacy, misleading, or violates any applicable laws.
  • Violating any patent, trademark, copyright, or proprietary rights.
  • Impersonating another individual or engaging in fraudulent conduct.
  • Hosting, intercepting, emulating, or redirecting Our proprietary communication protocols.
  • Framing Our Services, adding editorial comments, or modifying content.
  • Using Our Services for commercial purposes without explicit authorization.
  • Participating in fraudulent payment activities.
  • Sending spam emails or unsolicited messages to other users.

6. Payments

By utilizing Our legal consultation services, You agree to pay the applicable fees, which may be subject to periodic revisions. Please note that your network provider may impose additional charges for data usage. All payments must be made in Indian Rupees (INR). Transactions made via credit/debit cards, net banking, or other payment methods are processed through third-party payment gateways. We are not responsible for any delays or issues arising from their end. Upon successful payment, ChatExpertHub Pvt Ltd will issue a GST-compliant invoice, which will be sent to your registered WhatsApp number.

7. Refund Policy

Refunds may be requested under the following conditions:

  • If network issues, such as weak signal, background interference, or inaudible communication, disrupt the consultation.
  • If the consultant is unable to communicate effectively in the specified language.
  • If there is a considerable delay in receiving a response from the consultant.

Refund requests must be made within 30 days of payment. Once your request is received, it will be processed within two (2) weeks. The refund will be credited back to the original payment method used. Please note that approved refunds will be subject to applicable transaction fees.

Refunds will not be granted under the following circumstances:

  • The consultation request has already been processed (i.e., a consultant has been assigned).
  • Incorrect information was provided by you.
  • Your provided contact number was unreachable at the time of the consultation.

8. Disclaimer, Indemnification, and Liability Limitations

  • ChatExpertHub is not responsible for any loss, damage, or expenses incurred by You in connection with Our legal consultation services.
  • To the fullest extent permitted by law, You agree to indemnify and hold harmless the Company, its officers, directors, and employees from any claims, losses, damages, costs, and expenses arising from:

    1. Your use of the Services;
    2. Your violation of these Terms of Use or the Privacy Policy;
    3. Any infringement of intellectual property or other rights owned by the Company or a third party; or
    4. Your failure to comply with applicable laws and regulations.
  • To the fullest extent permitted by law, the Company and its affiliates will not be liable for any direct, indirect, special, incidental, punitive, exemplary, or consequential damages related to the Platform and/or Services, regardless of the legal basis, whether in warranty, contract, or tort (including negligence), even if the Company has been advised of the possibility of such damages. You acknowledge that under no circumstances, including negligence, shall the Company be liable to You or any other individual or entity for any damages, including, but not limited to, loss of profits, goodwill, data, or any other intangible losses, arising from:

    • Your use or inability to use the Platform and/or Services;
    • Your reliance on statements made by the Company in delivering the Services;
    • Any other matter relating to the Platform and/or Services.

9. Intellectual Property Rights

ChatExpertHub and its affiliates hold exclusive ownership of all intellectual property rights, including trademarks, copyrights, patents, and proprietary technologies related to the Platform. You are granted a limited, non-transferable license to access and use Our Services, but this does not grant you any ownership rights over the intellectual property. You are prohibited from reverse-engineering, modifying, or distributing any part of Our Services without obtaining Our express written consent.

11. Governing Law, Dispute Resolution & Jurisdiction

The terms of use and policies of the Platform will be governed by the laws of India. Any disputes that arise will fall under the exclusive jurisdiction of the civil courts in Bengaluru, Karnataka. Disputes should be initially raised in writing. If they remain unresolved within 30 days, arbitration will be conducted before a three-member panel in Bengaluru, in accordance with the Arbitration and Conciliation Act, 1996. The decision of the tribunal will be final and binding. ChatExpertHub reserves the right to seek injunctive relief in any competent court of jurisdiction.
